Acceptance and eligibility

By accessing the website, creating an account, submitting information, or placing an order, you agree to these Terms of Service and the policies linked from them. If you do not agree, do not use the website or submit an order.

You must be legally able to enter a purchase agreement and comply with laws or restrictions that apply to receiving, keeping, importing, reselling, or transporting live fish at the destination.

Product information and live-animal variation

HiGuppy aims to describe products accurately, but screens, lighting, age, sex, diet, stress, genetics, and natural variation can affect color, size, pattern, fin development, and appearance. Unless a listing clearly identifies an exact specimen, images may be representative.

Measurements, ages, ratios, strain names, and availability are reasonable estimates or descriptions rather than guarantees of exact future development. Fish can change appearance as they mature and adapt to a new environment.

Orders, prices, and acceptance

An order submission is an offer to purchase. HiGuppy may review inventory, fish condition, payment, destination, address, weather, carrier coverage, fraud risk, and other fulfillment factors before accepting or dispatching an order.

HiGuppy may correct listing, inventory, pricing, coupon, tax, or technical errors; request additional information; limit quantities; decline an order; or cancel an affected item. When an unfulfilled item is cancelled by HiGuppy, the appropriate payment adjustment will be made.

Current prices, shipping charges, taxes, and discounts are shown during checkout. Bank, currency-conversion, or payment-provider fees may be outside HiGuppy’s control.

Live-fish responsibilities

Purchasing live fish involves responsibilities that do not apply to ordinary merchandise. The buyer agrees to:

Provide accurate contact and delivery information.
Confirm that the destination can legally receive and keep the fish.
Prepare a suitable, cycled aquarium before delivery.
Monitor tracking and arrange prompt package receipt.
Protect the package from heat, freezing conditions, rain, theft, and prolonged outdoor exposure.
Inspect bags before opening and document arrival concerns promptly.
Follow reasonable acclimation and care guidance.
Avoid introducing fish into unsafe or incompatible conditions.

HiGuppy may delay dispatch when weather, carrier conditions, fish readiness, or the route creates avoidable risk.

Shipping, claims, cancellations, and refunds

Accounts and acceptable website use

Users must provide accurate information, protect account credentials, and notify HiGuppy of suspected unauthorized access. You may not use the website to:

Break applicable law or violate another person’s rights
Submit fraudulent orders, claims, reviews, or payment disputes
Interfere with website security, availability, or checkout

Impersonate HiGuppy, a customer, breeder, affiliate, or employee

HiGuppy may restrict access, cancel orders, suspend accounts, preserve records, or cooperate with providers and lawful authorities when misuse is reasonably suspected.

Third parties, disclaimers, and limitations

The website may rely on or link to third-party services such as payment processors, carriers, analytics, maps, reviews, social platforms, and embedded content. Their services, policies, availability, and accessibility are controlled by those providers.

Care content is general educational information and does not replace veterinary, legal, customs, or regulatory advice. A living animal’s long-term health and development depend on many conditions outside the seller’s control.

To the extent permitted by applicable law, HiGuppy is not responsible for indirect, incidental, special, or consequential loss arising from website use, carrier operations, aquarium conditions, third-party services, or use of products beyond the remedies stated in the applicable order policies. Nothing in these terms excludes rights or liability that cannot legally be excluded.

Does placing an order guarantee shipment?

No. Orders may require review of payment, stock, fish condition, destination, weather, carrier service, and address information before dispatch.

Are listing photos always the exact fish?

Only when the listing clearly says so. Otherwise, photos may represent the strain or product type, and natural variation should be expected.

Can these terms change?

Yes. HiGuppy may update website terms and policies as operations, laws, services, or features change. The version available when an order is placed generally applies to that transaction unless another written agreement states otherwise.
